These terms apply to all visitors to our website and to all customers who hire us for fencing or gate installation, repair, or maintenance work. We may update these terms from time to time. When we do, the effective date at the top of this page will change. Continued use of our website or services after a change is posted constitutes acceptance of the updated terms.
EC El Cerrito Fence provides residential and commercial fence installation, fence repair, gate installation, and related fencing services in El Cerrito, CA and surrounding communities. Services are performed by or under the supervision of our licensed crew.
The specific scope of work for each job is defined in the written estimate or contract provided to the customer before work begins. Services not listed in that written scope are not included in the agreed price and may be quoted separately if requested.
We reserve the right to decline any project that falls outside our area of expertise, service area, or availability.
All estimates are provided in writing after an on-site visit to your property. We do not provide binding quotes over the phone without seeing the job.
Written estimates are valid for 30 days from the date issued. After 30 days, material prices and labor availability may have changed, and a new estimate may be required.
An estimate is not a final contract. Work does not begin until both parties have agreed to the scope and price in writing. If site conditions differ materially from what was visible during the estimate visit - for example, buried concrete footings, unknown utility lines, or access issues that were not apparent - we will notify you before proceeding and provide a revised price for the additional work.
Change orders requested by the customer after work has begun will be priced separately and require written agreement before the additional work is performed.
Once a start date is agreed upon, we hold that date on our schedule. If you need to reschedule, please notify us at least 48 hours in advance so we can make other arrangements.
Cancellations made after materials have been ordered or cut may result in a restocking or materials fee. We will inform you of any such fees before they are applied.
We may reschedule work due to weather conditions that make safe or quality installation impossible. We will contact you as early as possible if a weather delay affects your scheduled start date.
Payment terms are set out in the written estimate or contract for your specific job. In general:
Overdue balances are subject to a late fee of 1.5% per month or the maximum rate permitted by California law, whichever is less. If an account must be referred to a collections agency or attorney, the customer is responsible for reasonable collection costs and attorney fees.

Where a permit is required by the City of El Cerrito or another local jurisdiction, we will apply for and obtain the permit before work begins, unless the customer has agreed in writing to handle the permit themselves.
Permit fees are passed through to the customer at cost and are listed separately in the written estimate. We are not responsible for delays caused by the permitting authority.
Work performed without a required permit - if the customer has specifically requested we proceed without one - is done at the customer's own risk. We will not assume liability for code violations, required modifications, or removal orders resulting from unpermitted work.
We stand behind our workmanship. If a defect in our installation work becomes apparent within one year of project completion, we will return to correct it at no additional charge. This workmanship warranty does not cover:
Except as stated above, services are provided "as is" without additional warranty of any kind, express or implied, to the fullest extent permitted by California law.
To the maximum extent permitted by law, EC El Cerrito Fence is not liable for any indirect, incidental, consequential, or punitive damages arising from our services or from use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim related to a specific project is limited to the amount paid by the customer for that project.
We maintain general liability insurance. Upon request, we can provide a certificate of insurance before work begins.
The content on our website - including text, images, and other materials - is provided for general informational purposes. We make no guarantees that the information is complete, current, or error-free.
You may not copy, reproduce, or republish any content from our website without our written permission. You may not use our website for any unlawful purpose or in a way that could damage our reputation or interfere with our business.
If a dispute arises between you and EC El Cerrito Fence, we ask that you contact us first to try to resolve it informally. Most issues can be resolved quickly with a direct conversation.
If informal resolution is not possible, the parties agree to attempt mediation before pursuing litigation. Mediation would take place in Contra Costa County, California, with a mutually agreed-upon mediator.
If mediation does not resolve the dispute, any legal action must be filed in the state or federal courts located in Contra Costa County, California. Both parties consent to the jurisdiction of those courts.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal claims arising from these terms or our services will be governed by California law.
We may revise these Terms and Conditions at any time. The revised version will be posted on this page with an updated effective date. Your continued use of our website or services after revisions are posted means you accept the updated terms. We will not apply changes retroactively to projects that are already underway under a signed agreement.
